A divorced parent can now claim maintenance for his/her adult dependent children-the Supreme Court of Appeal has ruled. This means that in a divorce action, a parent cannot only claim maintenance on behalf of the minor children below the age of 18 but also on behalf of those who are 18 and older as long as such adults children are still financially dependent on their parents.
The issue to be determined by the Supreme Court of Appeal was whether a parent has legal standing to act on behalf of adult dependent children to claim maintenance on their behalf, or whether the children have to make the claim for themselves.
