Business rescue, under the Companies Act 71 of 2008, is appropriate when a company is financially distressed but still viable. 📝

A company is financially distressed if it is unlikely to pay its debts within the next six months, or likely to become insolvent. However, rescue should be considered where there is a reasonable prospect of recovery.

You may consider business rescue when:

Cash flow problems are temporary but severe
Creditors are threatening legal action
The company is technically insolvent but operationally viable
There is potential to restructure debt or secure investment
Business rescue offers temporary protection from creditors while a practitioner develops a plan to restructure the business.

If there is no realistic prospect of recovery, liquidation may be the more appropriate route.

An eviction is lawful only if it complies strictly with the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE Act) and is authorised by a court. 📄

A landlord may not remove a tenant without a court order, even if rent has not been paid.

The process generally requires:
- Proper cancellation of the lease (if applicable)
- Written notice of proceedings served on the tenant
- Notice to the local municipality
- A court hearing
- A judicial determination that the eviction is just and equitable

The court will consider factors such as the rights of children, elderly or vulnerable persons, availability of alternative accommodation, and fairness to both parties.

Any eviction carried out without a court order, including changing locks, cutting utilities, or intimidation, is unlawful and can expose a landlord to serious legal consequences.
