If you do not create an Antenuptial Agreement(ANC) in South Africa you are automatically married 'in community of property', which assumes that all assets and debts are shared.

But what does this mean? Without an Antenuptial Agreement:

2. If one spouse owns a business and encounters financial insolvency, the jointly owned home and all assets become susceptible to debt collectors.
3. Financial and contractual autonomy is compromised, necessitating the consent of both partners for various transactions, including the sale of shares.
4. In the unfortunate circumstance of a partner's demise, the joint estate status dictates that both the deceased and surviving partner's estates are merged and administrated. This could pose problems for the surviving partner, leading to legal complexities, potential difficulty accessing funds, and the emotional distress of losing a loved one.

- When you're married in community of property, your individual estates become one shared estate. This means both spouses share all assets and debts from this joint estate. Also, some actions may require the consent, possibly in writing, of the other spouse under section 15 of the Act.

- On the other hand, if you marry out of community of property, your estates remain separate. So, if one spouse's estate faces financial troubles, it won't affect the other spouse's estate.

- If you choose to marry without the accrual system, the growth in your individual estates during the marriage won't be considered when the marriage ends.

Here are some common mistakes made when purchasing a property:

- Looking for the perfect property – Don’t pass over the ideal property in the hopes of finding the perfect property.
- Beware of nasty surprises – Be vigilant and make sure you inspect the property thoroughly to avoid and nasty surprises.
- Not every home's asking price is negotiable – Don’t risk offending the seller and possibly losing your ideal home by haggling over the price too much.
- Looks can be deceiving - Buyers should focus more on the quality of the property than the superficial factors.

To answer this, we must understand the difference between latent and patent defects.

Latent defects are not visible or apparent upon reasonable inspection of the property, or which a purchaser would not be expected to discover through reasonable diligence. Such as a leaky roof.

On the other hand, Patent defects are visible or apparent defects that would be discovered through reasonable inspection. These defects will either be fixed before the sale goes through or the seller reduces the price so that the new owner can fix the defect.

Common Law Dictates:
-If the Seller gives the purchaser an express written warranty that the property is sold free from any defects and the leak occurs, then the Seller is held liable as there was a breach of contract.
-If the Seller misrepresents to the Purchaser the property’s condition and are aware of the Latent defect, the Seller is held liable even if sold “voetstoots”.

In short, the Seller is responsible for fixing the leak, unless it was expressly agreed that the seller is free from any liability regarding defects discovered after the sale of the property.
