The impact of the COVID 19 pandemic will have a lasting effect on the South African economy. It will consequently impact on contractual obligations, however the South African law makes provision for force majeure when it becomes impossible for parties to perform their contractual obligations. The South African law provides for two types namely contractual force majeure clauses and common law force majeure.

The South African law does however not excuse the performance of a contract in all circumstances of force majeure.

The requirements are inter alia the following: -

1. The impossibility must be objectively impossible.
2. It must be absolute as opposed to probable and relative.
3. The impossibility must be unavoidable
4. It must not be the fault of either party.
5. The mere fact that an event was foreseeable, does not necessarily mean that it ought to have been foreseeable or that it is avoidable.
