Did you know that:

You are entitled to a divorce If you can prove or allege that you and your spouse can no longer live together as husband and wife, that you lost love and respect towards your spouse and there is no prospect of saving your marriage.

You do not have to get your spouse's permission to get a divorce. If your spouse is not willing to get divorced, you can get a divorce granted without his or her consent.

Any civil marriage and customary marriage(whether registered or unregistered) need to be dissolved by court, any regional or high court having jurisdiction.

There are two types of divorces, contested and uncontested divorce.

Understanding Divorce Action.

You are entitled to a divorce If you can prove that you and your spouse can no longer live together as husband and wife, that you lost love and respect towards your spouse and there is no chance of resolving your differences.

As we provide Property Law services, we wish to share an interesting aspect of property law to our followers and clients.

SPOLIATION

Spoliation is the wrongful deprivation of another person’s right of possession.

The aim of spoliation order is to prevent self-help; it seeks to prevent people from taking the law into their own hands.

Our law requires that you approach a court for assistance; self-help or taking the law into your own hands is not an option.

So if you remove the tenant or deny tenant's access to the leased premises without a court order, you face having to immediately restore possession to the tenant via a spoliation order.

The important thing is that at this stage, the court has no interest in how strong or weak your actual case against the tenant is. All that counts now is how you dispossessed the tenant, not whether you are the owner nor whether you have any legal right over the property.

So to succeed in obtaining a spoliation order, all the tenant has to prove is that:-

they were in peaceful and undisturbed possession (occupation) of the property, and
they were unlawfully (without a court order) deprived of that possession (occupation) of the property.

The critical question here is whether or not the tenant consented freely and genuinely to the dispossession. If so, the dispossession was lawful. If not, it was unlawful. Thus spoliation ‘may take place in numerous unlawful ways. It may be unlawful because it was by force, or by threat of force or just without consent.

Spoliation order is not final order, it can not protect you forever. If the owner obtains a court order to remove you from the property then your spoliation order falls away.

Owners of the properties or any assets like motor vehicle, must not take the law into their own hands, they must approach court to obtain court order so as to recover/reclaim their properties or assets. If the owner fails to comply with the law, they run a risk of being taken to court for Spoliation order. You can imagine how imbarrassing it sounds to be taken to court and be ordered to restore possession of the property to the tenants.
