MOVEMENT OF CHILDREN – LEVEL 4 LOCKDOWN

1. The new regulations published for Level 4 Lockdown, makes provision for the movement of children between co-holders of parental responsibilities and rights or a caregiver, as defined in the Children’s Act.

2. The regulation provides that where parents or caregivers are in the SAME metropolitan area or district, the movement of children between the parents or caregivers are allowed, if in possession of:

2.1 A Court Order; OR
2.2 Parental Agreement or parenting plan, registered with the Family Advocate;
2.3 Permit issued by a Magistrate, where you do not have one of the above. The Magistrate must be provided with a birth certificate (original or certified copy) of the child and written reasons why the movement of the child is necessary.

The regulations do not specify whether the documents in 2.1 and 2.2 above must be original or a copy of certified copy. We suggest, if possible use an original or certified copy.

3. The regulation further provides that where parents or caregivers are in DIFFERENT metropolitan areas, districts or Provinces, the movement of children between the parents or caregivers are allowed, if in possession of a Permit issued by a Magistrate.

4. If a child was not at the residence of the primary caregiver during the lockdown and who could not travel between provinces, metropolitan and district areas, can on a once-off basis return to their primary residence, if in possession of a Permit issued by a Magistrate.

5. The Magistrate in 3 and 4 above, must be provided with:

5.1 A Court Order;
5.2 Parental Agreement or parenting plan, registered with the Family Advocate; OR
5.3 A birth certificate (original or certified copy) of the child; AND
5.4 Written reasons why the movement of the child is necessary.

We are of the view that a permit must be issued by the Magistrate if either of 5.1 or 5.2 is provided and if a parent or caregiver cannot provide this, then the documents in 5.3 and 5.4 must be provided.

5. The household to which the child has to move, must be free of COVID-19. It is not clear from the regulations how this is to be determined, but we are of the opinion that this will mean that the parent or caregiver to whom the child is returning must not have been tested positive for COVID-19.
