Requirements for criminal liability:

1. Conduct- this can come in a form of an act or an omission. Keep in mind omissions are only punishable if there was a duty to act positively and you fail to do so.

2. The conduct must comply with the definitional elements of the crime.

3. The conduct must be unlawful and considered to be so by the law of the land.

4. The act/conduct must be culpable. The test for culpability will look into the ability to appreciate the wrongfulness of the act and the ability to act in accordance with such appreciation, further the act must have been commited with either intent or negligence.

In South Africa a marriage may either be desolved by the Regional or High Court, on one or more of the following grounds:

1. Irretrievable breakdown of the marriage, if the court is satisfied that the marriage relationship between the parties has reached such a state of disintegration that there are no reasonable prospects of the restoration of a normal marriage relationship between them.

2. Incurable mental illness for a continuous period of at least two years.

3. Continuous unconsciousness of a period of at least six months.

It is not unusual to hear stories of parents who will do anything not to comply with their maintence obligations to their children. A child whether born in or out of wedlock is entitled to resonable maintenance from both parents according to their respective means. Failure to pay child maintenance is a criminal offence and is punishable by a fine or imprisonment.
