⚖️ Who chooses the transferring attorney when a property is sold?

Many buyers assume that because they pay the transfer costs, they get to choose the transferring attorney.

In most property transactions in South Africa, that is not the case.

The seller usually appoints the transferring attorney because the seller carries the risk in the transaction until the property is registered in the buyer’s name.

However, in one property transaction there can be up to three different attorneys involved:
