I read numerous statements and articles regarding RAF's financial difficulties and allegations that the Fund is bankrupt. I can say without a shadow of doubt that if RAF is indeed bankrupt it is the architect of its own downfall. I say the above based on the folowing grounds:
RAF Act as amended clearly gives the Fund grace period of 120 days to investigate and make an Offer. Unfortunatly RAF fails to use that 120 days and endup litigating on the issue of merits and spend hundreds of thousands of Rands on legal fees and that is absurd to say the least because of the following:
1. If the claim is that of minor children, mentally ill person and passengers, hospital records and the docket are enough for the RAF to make a concession within 120 days;
2. Claims involving drivers and pedestrians the RAF is still in a position to make an offer subject to apportionment.
A typical example
A claim for R1 million, claimant was passenger and the Fund fails to settle the merits in 120 days. The matter is litigated and issues are separated and on the day of the trial the issue of merits is settled 100% in favour of the Plaintiff, RAF asks for postponement to deal with Quantum. Be mindfull of the fact that the expert reports were filed sometime ago and the RAF once again failed even to consider them. 2 years once again passes and the matter comes to trial and the RAF attorneys ask for adjournment and tender costs. 2 months before the trial they ask the Plaintiff to attend their own experts which takes another year or two and finally the matter is back again on the roll. RAF Attorneys even attempt to stand the matter down for three days with all experts in court and on the 3rd day the Offer of R1 million is made (the exact amount claimed by the Plaintiff).
RAF makes the following payments:
(a) Pays R1 million to Plaintiff;
(b) Pays R 300 000 to experts in court;
(c) Pays R 350 000 for Pl. Att fees;
(d) Pays R 200 000 to its own Attorneys
(e) Pays R 30 000 to its Assessors.

The example above demonstrate the true realities and difficulties which are all orcherstrated by RAF to drive itself to bankrupcy so that they can pave a way for RABS Bill.

How on earth does one justifies the escalation of payout from a mere R1 million to R2 million. And they always say that big money goes to Attorneys forgetting (pretending) that the Attorneys are entitled to their fees in proportionate to the work done. If RAF was settling the matters as prescribed in the Act, Attorneys would be getting back plus minus R50 000 even less and billions of Rands would be saved.
The following has also been noted:
1. RAF employees tend to undermine small firms and refuse to make Offers to them;
2. System is now riddled with corruption with Fund's employees demanding bribes for Offers;
3. Fund's employees forever ignoring telephone calls and making empty promises;
4. Fund's Attorneys not interested to make any Offers or bring mattets to finality and focus on generating fees.

This problem can only be fixed by the very same Fund and with great respect to the Fund and Gov.t it can onle get worse.
