Many banks and other institutions offer to assist their clients make a will, they tend to persuade the clients to appoint the institution as executor. However, especially for smaller estates, this is often not advisable. Often it is better to appoint one of the beneficiaries as executor of the will. Such executor can then appoint an attorney to look after the legal formalities and negotiate a fee for this. When the estate is under a certain amount, the figure being published in the Government Gazette, its administration is greatly simplified.

The owner of property is the person in whose name the immovable property is registered in terms of the Deeds Registries Act 47 of 1973. There are instances, however, where you can totally or partly own immovable property, without it being registered in your name, or not own property despite it being registered in your name, for example:
