NM Heinze Attorneys Inc at the Gauteng Public Consultation πŸ‡ΏπŸ‡¦βš–οΈ

On Friday, 30 January 2026, NM Heinze Attorneys Inc attended the Gauteng Public Consultation on the Revised Draft White Paper on Citizenship, Immigration and Refugee Protection.

We actively participated by submitting valuable verbal inputs and will be following this up with detailed written submissions ahead of the closing date for public comment. Meaningful public participation is essential to shaping legislation that is practical, constitutional, and fair β€” and we take that responsibility seriously.

We also had productive one-on-one engagements with the Chief Director: Strategy and Institutional Performance, who encouraged us to formally submit our proposals and recommendations to the Department.

It was a privilege to briefly engage with β€” and share a quick moment before lunch with β€” the Director-General of Home Affairs and the Deputy Minister of Home Affairs.

And finally… a moment that reminded us why we do what we do:
during the Director-General’s closing remarks, the room erupted in laughter when he said:

β€œNadia sends me a lot of letters of demand. Now I know who the person is taking me to court all the time.”

If that’s not confirmation that we’re showing up, being heard, and fighting hard for our clients, we don’t know what is.

⚠️ Immigration Backlog Clarification – Revised Immigration Directive 22 of 2025

On 30 September 2025, the Department of Home Affairs issued a revised Immigration Directive 22 of 2025, correcting an earlier error.

βœ… The backlog concession now applies only to foreign nationals with pending waiver applications or pending visa appeal applications.
βœ… These applicants are granted a temporary extension of their current visa until 31 March 2026 and may travel using a VFS receipt, without being declared undesirable or subjected to a travel ban.

❌ Permanent Residence (PR) appeals are no longer covered under this directive.
❌ The concession does not apply to foreign nationals awaiting:
β€’ First-time / initial visa applications (TRV)
β€’ Visa renewals (TRR)
β€’ Change of status or conditions (TRC)
β€’ Permanent Residence permits or PR appeals

This revision confirms what we previously cautioned: PR appeal applicants should ensure that their temporary residence status remains valid at all times, in compliance with South Africa’s Immigration Act and Regulations.
