In addition to our article posted on 28th of April 2020 - the consequence of non-compliance :

On the 29th of April 2020 Dr. Nkosazana Dlamini Zuma, Minister of Co-Operative Governance and Traditional Affairs issued regulations in terms of section 27(2) of the Disaster Management Act 2002 pertaining to the implementation of the Alert Level 4 lockdown which will commence on the 1st of May 2020.
In terms of Regulation 16(6) all industries, businesses and entities, both in the private and public sector, which are permitted to operate during Alert Level 4, must implement a Workplace Plan prior to the reopening of an enterprise that has to adhere to certain requirements as determined by the Minister. For small companies, the plan can be basic, however for medium and large companies the plan has to be more detailed and entails more complex requirements that must be adhered to.

Failure to implement a Workplace Plan can result in a fine and/or up-to six-month imprisonment.

As employees are systematically returning to the workplace, the lockdown rules and regulations as issued by the President and the Minister of Cooperative Governance and Traditional Affairs requires from employers to throughout the lockdown period ensure that all possible scenarios are taken into account and risk factors be addressed which may lead to the spread of the Covid-19 Virus. This means creating new policies, procedures, and workplace protocols for surveillance, risk assessment, and prevention which all who enter the workplace should strictly comply with to prevent the risk of infection and the spread of the virus. We believe that these requirements imposed on the employer should be implemented by also taking into account the productivity of all employees to ensure that the company’s financial future is minimally affected versus the procedures to be taken. The drafting of such policies, procedures, and protocols is not only time-consuming but should be done strictly in accordance with the prescribed directives.
