VARIATION OR SETTING ASIDE OF AN EXISTING MAINTENANCE ORDER

In the event that a party can no longer meet their financial obligations in terms of a maintenance order, they may approach the Court for a variation or setting aside of an existing maintenance order.

Section 16(1)(b) of the Maintenance Act, 99 of 1998 provides that, the maintenance court may – in the case where a maintenance order is in force:
(i) Make a maintenance order in substitution of an existing maintenance order; or
(ii) Discharge such maintenance order.

Therefore, in order to succeed in an application for reduction of maintenance or the setting aside of a maintenance order, the applicant must successfully prove the following:

1. A reduced income; and
2. The inability to pay the current maintenance amount.

In cases where a person fails to prove that there is a material change in his/her financial circumstances, an application for a reduction in maintenance or the setting aside of a maintenance order will not succeed.
