Illegitimate children

illegitimate children are children born out of marriage, in most cases they used their mothers surname,by court order they may be registered in their fathers surname and a new birth certificate is issued.

Debt Cancellation.

What is debt concellation or debt relief?
To provide relief for over-indebted South Africans who have no other means of paying their debts.The act allows certain applicants to have their debt suspended in part or in full for up to 24 months or be removed all together if the financial circumstances of the applicant do not improve.

criteria for meeting this debt write-off include:
debt is not more than R50,000;
Where the unsecured debt was accrued through unsecured credit agreements, unsecured short term credit transactions or unsecured credit facilities only;

Where the person earned no more than R7,500 a month over the last six months;

The bill also introduces a number of new offences related to debt intervention.

Fellow South Africans, deceased estate is a sad law because everyday I come across sad scenarios and sad endings.

Why am i saying this? lot of parents don't disclose their financial position to loved ones or families they don't nominate beneficiaries neither update their details e.g new address or cellphone. Hence making them
untraceable as financial companies or banks don't know where to find their families or beneficiaries.

The importance of a will. In law we call it testate succession which is when a person dies having a will.

When should you draft a will?
As soon as you aquire assets, have money, property,land, investments or shares etc. You can draft your will at a Law firm and banks or you can draft it yourself.
+ You must be older than 16
+ The will must be in writing
+ Each page of the will must be signed by yourself and 2 witness who must be older than 14
+ If any changes have been made by ink the will must be signed/initialed next to the changes together with the witnesses.

The importance is that should you die you know that your children and your loved ones are taken care of.

Deceased estate it is opened or reported when a person dies leaving money for examples money in the bank, shares, pension fund or provident fund, investment and assets such as house, car, land etc.

It must be reported at the nearest Magistrate court or Master of the High court, if there is a will must be distributed according to that will.

It must be reported by the surviving spouse(wife or husband) if there is no surviving spouse there dependant( childern). If he/she was not married no children then his or her parents (father and mother) if no parents his/her siblings(brother and sisters

How UIF works in case of death.

Unemployment insurance fund(UIF): if a worker dies his/her surviving spouse or dependants(children)must be 18 years or older and lodge a claim within 6months of death .

In case there are no surviving spouse and children are under 18 years a representative must be appointed eg a relative such as grandparents, uncle, aunty, or a social worker needs to be approached for help.

You apply for child maintenance at your nearest magistrate court.

Who may apply for child maintenance?

Biological parent father or mother of the child or guardian of the child.

Why do we apply for child maintenance.
If the father is working and not talking care of the child.
Even the child's father has the right to claim child maintenance aganist the child' mother if she is working and failed to take of her child.
