Have you seen the proposed amendments to the Companies Act, 71 of 2008?

The Companies Amendment Bill, 2021 (“the Bill”) was published for public comment on the 1st of October 2021.

The amendments in the Bill aim to achieve three broad categories of policy objectives;

(i) to improve the ease of doing business
(ii) providing for greater transparency and equity between directors and senior management on one hand and shareholders and workers on the other, and
(iii) address money laundering issues.

The Companies Amendment Bill, 2021 was published for public comment on 1 October 2021 and seeks to amend the Companies Act, 71 of 2008 in several respects.

Disciplinary actions against employees MUST be substantively & procedurally fair.

Non-compliance can lead to a costly expense for your business.

"The Labour Relations Act 66 of 1995 (the LRA) provides the following remedies for an unfair dismissal:

- The employer to reinstate the employee on the same terms and conditions of employment before the dismissal.
- The employer to re-employ the employee, which may be on new terms and conditions of employment.
- The employer to pay compensation to the employee."
