As a result of the pandemic, most parents have been enquiring as to whether there are any remedies available to enforce maintenance order against defaulting parent. A simple answer is YES THERE ARE REMADIES AVAILABLE. In terms of s 26 of the Maintenance Act, when a maintenance order has been granted and the person against whom it has been granted failed to make payment in accordance with the order, such an order is enforceable by ex*****on against the defaulter’s property. If a specific amount was ordered, that amount attracts interest. In particular, s 26(4) of the Maintenance Act specifically provides that ‘any pension, annuity, gratuity or compassionate allowance or other similar benefit shall be liable to be attached or subjected to ex*****on under any warrant of ex*****on or any order issued … in order to satisfy a maintenance order.
