UNDERSTAND YOUR SOUTH AFRICAN PAYSLIP 💫

Your payslip is one of the most important documents when it comes to working in South Africa, as it is written proof of your employment and shows you how the money you take home is calculated. Not all payslips look the same, but they should all have a number of basic items listed that you need to understand. I explain some common terms that you would find on your payslip to help you better understand the amount you take home at the end of each month.

DEDUCTIONS
There are three types of deductions –

1. Compulsory
Not optional, compulsory. This includes your tax (also called PAYE) deduction, UIF contributions and any court order, garnishee order or arbitration award. It could also include union subscriptions if these are part of a collective agreement for your industry.

2. Benefit deductions.
Could be voluntary or compulsory. This includes company benefits like pension, medical aid, life cover and income protector. These are usually voluntary, but can sometimes be compulsory depending on your employer’s policy.

3. Voluntary deductions.
This includes staff loans, donations to charities, gym fees and, in some cases, union fees. It is important to note that voluntary deductions may not exceed 25% of your gross pay.

Basic pay
This is the rate of payment agreed upon between you and your employer. It does not include bonuses or overtime.

Cost to company (CTC)
This is the total salary package of the employee including all benefits. This is your pre-tax amount, it is not what you actually take home.

Gross pay
This is the amount that you actually earn before any deductions.

Net pay
Commonly called your “take home salary”. This is the amount paid to you after all deductions, ie what is actually paid into your account.

PAYE
This stands for “Pay-As-You-Earn”, which is the income tax that is deducted from your pay. Below are taxable components found on your payslip:

Taxable earnings
Refers to the taxable income that an individual receives i.e. your salary.
Taxable perks - refers to your total salary package and includes all employee benefits.

UIF
This is your contribution to the Unemployment Insurance Fund (UIF) paid by your employer every month. All employees, as well as their employers, are liable for these contributions. You will have the right to claim from the UIF in cases where you become unemployed after contributing to the UIF, or your company does not pay for maternity leave.

Understanding your payslip is the first step to your financial freedom! Knowing how much you earn, what your expenses are, as well as how much is being deducted from your salary, will put you in a better position to have control over your finances.

Thinking of Changing Your Matrimonial Property Regime? 📌

Whether you're married in community of property and wish to change, or married out of community of property—with or without accrual—you can apply to amend your matrimonial property system.

It is possible.
Section 21(1) of the Matrimonial Property Act 88 of 1984 allows spouses to apply jointly to the High Court of South Africa for consent to vary the matrimonial property regime governing their marriage.

Before applying, the following requirements must be met:

1. ✅ Sound reasons must exist for the proposed change.
2. 📢 Notice of intention must be:
- Given to the Registrar of Deeds
- Published in the Government Gazette and two local newspapers (at least two weeks before the hearing)
- Sent by registered post to all known creditors
3. 📄 A draft notarial contract must be attached to the application.
4. 🛡️ The rights of creditors must be preserved in the proposed contract.
5. ⚖️ The change must not prejudice any other person.
6. 📊 The application must include details of both spouses’ assets and liabilities, enabling the court to assess the validity and fairness of the proposed change.

Sihlali v Minister of Police [2025] ZAECMHC 79 (21 August 2025)

¶Facts

The plaintiff, Sihlali, a Candidate Attorney employed by Legal Aid South Africa, was on duty at the Tsolo Magistrates’ Court when he was accosted by SAPS officers in civilian clothing after giving R10 to a young man. The officers accused him of drug dealing, forcibly searched him in public, and detained him without charging or bringing him before a court.

Sihlali was pushed into a police van, transported to the magistrates' court, and publicly humiliated. He maintained there was no reasonable suspicion linking him to drug-related activities.

Defendant’s Version

The Minister of Police, represented by SAPS, denied any arrest or detention, claiming officers observed Sihlali exchanging an item with a known drug dealer and that he fled when approached. They alleged he refused to be searched, identified himself as an attorney, and was later given a lift to his workplace. However, contradictions emerged in Sgt Thile’s testimony, undermining the credibility of the defence.

Plaintiff’s Version

Sihlali testified that two men in civilian clothing, wearing a balaclava and hoodie, forcefully grabbed him, pushed him to the ground, searched him, and caused his belongings to fall out. Believing he was being robbed, he resisted and repeatedly stated he was an attorney uninvolved in drugs. The men later identified themselves as SAPS officers, apologised, and offered to return him to court.

¶Issues

1. Whether the plaintiff’s arrest and detention were lawful.

2. Whether the search conducted complied with the Criminal Procedure Act.

3. Whether SAPS officers acted within their legal authority.

¶Court’s Analysis

There was no evidence linking Sihlali to drugs.

The plaintiff’s version was found more probable and credible than the defendants. SAPS officers restricted Sihlali’s movement, physically controlled him, searched him without consent or reasonable grounds, and subjected him to public humiliation. These actions constituted unlawful arrest, search, and detention.

¶Held

The court rejected the defendant’s claim that no arrest occurred.

SAPS officers acted outside the scope of the law.

The Minister of Police was held vicariously liable.

¶Order

The court awarded the Plaintiff (Sihlali) R120,000 in damages for:

Unlawful arrest

Unlawful search

Unlawful detention

It is submitted that SAPS officers must have reasonable grounds and comply with the Criminal Procedure Act when arresting or searching individuals. Failure to do so constitutes a violation of constitutional rights and exposes the State to civil liability.

FORMER ATTORNEY CONVICTED AFTER SWINDLING CLIENTS OF THEIR ROAD ACCIDENT FUND’S Claims 💼

The Mpumalanga Specialised Commercial Crimes’ Court sitting in Middelburg convicted former attorney, Mantladi Jo-Anne Mmela (43) on four counts of theft. The accused was practicing as a sole practitioner for Mmela Attorneys when the crime was committed between June 2019 and March 2022. The accused lodged claims against the Road Accident Fund (RAF) on behalf of her clients which were subsequently paid out. The money was paid by Road Accident Fund into the trust account of Mmela Incorporated Attorneys for the benefit of her clients totaling an amount of over R4.1 million.

The incident came to light after one of the victims reported that Mmela failed to pay her. The investigation ensued and led to the arrest of the accused in 2022. She was granted bail and absconded which resulted to the warrant of arrest issued. Mmela was re-arrested in February 2024 and has been in custody since. During trial, the accused pleaded not guilty, and Senior State Advocate Henry Nxumalo presented evidence of the witnesses to prove the allegations levelled against her. The accused was convicted on four counts of theft and the matter was postponed to 21 August 2025 for sentencing in the same court.

The National Prosecuting Authority (NPA) welcomes the conviction as a significant step in the fight against theft of trust monies by attorneys as breach of trust more so the victims of motor vehicle accidents. The collaboration against fighting such crimes yielded positive results in this matter. The NPA remains committed to fighting financial crimes in ensuring that those who deprive claimants of their monies are prosecuted.

COURT NETS ANOTHER BUSINESSMAN FOR FAILING TO SUBMIT TAX Returns ⚖️

Bellville, South Africa, The Bellville Magistrates Court has fined another businessman, Roelof Serdyn, after he failed to submit Income Tax returns, Pay as You Earn returns, Value Added Tax returns.

The court fined Serdyn R82 000 with R42 000 paid immediately after the sentence and the balance of R40 000 paid in monthly instalments of R5 000. A further cumulative amount of R164 000-00 or in the alternative 246 months imprisonment was suspended for a period of five years on certain conditions.

Mr Serdyn was charged with his company, AKVABA (PTY) LTD, but charges against his company were withdrawn after it was liquidated. The court heard that Akvaba (Pty) Ltd was registered as a taxpayer and was therefore obligated to comply with all tax obligations towards the South African Revenue Services (SARS). Roelof Serdyn was the representative taxpayer, employer and representative vendor of Akvaba (Pty) Ltd. He was responsible for the company’s tax affairs which included the submission of all tax returns (IT, PAYE and VAT) of Akvaba (Pty) Ltd.

The offenses were committed between August 2018 and February 2024 and he was convicted of one count of failure to submit an Income Tax return, 8 counts of failure to submit Pay as You Earn (EMP201) returns and 32 counts of failure to submit VAT returns - all in contravention of the Tax Administration Act.

The accused ignored the reminders and final demand notices SARS issued to him. When he was summonsed to appear in court, the returns were submitted.

This case serves as a warning to persons acting as
representative Vendors, representative employers and public
officers that serving in these positions impose duties and
responsibilities on the incumbent and that these duties and
responsibilities should not be taken lightly as non-compliance with
such duties will have serious consequences for such incumbents
in their personal capacity.

The sentence in this case follows closely on the cases of J W Lubbe (and Jacor Transport Holding) who was sentenced to a fine of R148 000-00 on 11 June 2025, H L Van der Westhuizen (and Tempo Konstruksie CC) who was sentenced to a fine of R126 000-00 on 30 May 2025 and A and Y Wholesale Retail Enterprise CC and I Mayet who was sented to a fine of R96 000 on 12 June 2023 for similarly not filing tax returns as they were obliged to do.

The NPA welcomes the sentence as it sends out a stern warning to all taxpayers who do not comply with their duties, as well as those who endeavour to challenge the criminal justice system.
