⚖️ SECURING A CHILD’S FUTURE THROUGH THE LAW ⚖️

At Lazarus Joshua Attorneys Incorporated, we understand that maintenance obligations do not end when employment does.

Our client, the biological mother of a minor child, approached us after the child’s father repeatedly failed to comply with an existing maintenance order. When the father left his employment and became entitled to pension benefits, urgent legal intervention was required to safeguard the child’s future.

Acting swiftly, we successfully interdicted the payment of the father’s pension benefits and approached the Maintenance Court for relief. We sought an order directing that a lump sum be deducted from the pension fund and paid into an interest-bearing account administered by the Master of the High Court.

Supported by established case law, we successfully argued that this mechanism would ensure the ongoing maintenance needs of the minor child were protected despite the father’s history of non-compliance.

The Maintenance Court granted the application. The lump sum will now be held by the Master of the High Court, who will administer monthly maintenance payments for the benefit of the child.

This outcome serves as a powerful reminder that the courts will act decisively to protect the best interests of children and that maintenance obligations cannot be avoided through changes in employment status.

🚨 15 Years Avoided. Freedom Preserved. Justice Strategically Achieved. 🚨

This morning, our criminal defence team successfully concluded a highly sensitive and complex culpable homicide matter arising from a tragic motor vehicle accident.

The matter involved allegations that our client, who was driving a bakkie at the time, had been using a cellular phone and driving recklessly and negligently when the accident occurred. Tragically, one passenger lost his life and another sustained serious injuries.

The State initially sought a conviction coupled with a sentence of 15 years' imprisonment.

Following careful analysis of the evidence, extensive consultations with our client, and strategic engagement with the prosecution, we elected to make detailed representations and enter into negotiations with the State.

The result?

✅ No imprisonment.

✅ No 15-year custodial sentence.

✅ A negotiated plea agreement.

✅ A suspended sentence and fine.

While nothing can undo the tragic consequences of the accident, our duty was to protect our client's rights, minimise his legal exposure, and secure the best possible outcome under exceptionally difficult circumstances.

When Courts Become Theatre: Justice… or a Warning Shot?

If Julius Malema were to receive five years’ direct imprisonment, we must ask:

Is this justice — or punishment designed to send a message?

South African law is clear. Sentencing must balance:
The crime. The offender. The interests of society. (S v Zinn)

And as held in S v Rabie:
Punishment must fit both the crime and the individual — with a measure of mercy.

Courts have warned:
An accused must not be sacrificed for deterrence alone (S v Scott-Crossley).

Yes — unlawful firearm use is serious.
But justice is not only about punishment. It must also:
• Consider rehabilitation
• Preserve dignity
• Remain proportionate

Direct imprisonment is not the only option — nor always the right one.

When sentencing becomes excessive, it risks undermining the very system it seeks to uphold.

This is bigger than one individual.
It’s about whether justice remains balanced — or becomes symbolic.
