Engagement called off. Who keeps the ring? 💍

Most people assume a gift is a gift. But an engagement ring is not an ordinary present. In 2014 the Eastern Cape High Court treated a ring as given on one condition: that the wedding goes ahead. The engagement ended, so the ring had to go back.

The same reasoning applies to other bigger gifts given because of the engagement. Small tokens of affection, like flowers or a birthday present, stay where they are.

Who ended it, and why, can also change the answer. Every case turns on its facts.

Did you know the husband can take the wife's surname? 💍

For decades the answer in South Africa was no. A wife could take her husband's surname with a simple tick at Home Affairs. A husband who wanted his wife's surname had to apply for a formal change of name, give reasons, and wait for approval.

In September 2025 the Constitutional Court ended that. A Bloemfontein couple had agreed before their wedding that he would take her surname, to keep her late parents' name alive. Home Affairs turned them away. They took it to the highest court in the country and won.

So today either spouse can keep their own surname, take the other's, or double-barrel the two, through the same simple process at Home Affairs.

If an official tells you otherwise, they are behind. The law has changed.

"You can fetch them every second weekend." 📝

Arrangements like this one are made every day, in kitchens and over the phone, between parents doing their best. And most of the time they work. Until the day they do not.

When that day comes, a verbal arrangement about your children is worth very little. There is nothing to show a court, nothing to enforce, and the disagreement lands on the children.

A parenting plan fixes that. It is a written, signed agreement covering where the children live, when each parent sees them, schooling, holidays and maintenance. Registered with the Family Advocate or made an order of court, it becomes something a court can actually enforce.

Wondering why I chose family law? Four years in, the answer is simpler than ever. 💙

Family law is people at their most vulnerable. A divorce, a maintenance dispute, a parenting plan. These are not case numbers. They are homes, children and new beginnings.

"But what about the children?" It's the first question almost every parent asks. 💙

When parents separate in South Africa, the law works from one principle above all others: the best interests of the child. Not the wishes of the parents, the wellbeing of the child.

In practice, that usually means:

• Both parents stay involved in their children's lives wherever it is safe and possible
• A parenting plan sets out where the children live, time with each parent, schooling and support
• Children are never asked to "choose" a side

Divorce changes a family. With the right guidance, it does not have to shake a child's sense of safety.
