What now?

This is one of the questions that comes up more often than most people expect.

A spouse relocates for work, the marriage deteriorates, and you are left in South Africa wondering whether you can even start divorce proceedings when the other party is in another country.

The short answer is yes.

South African courts can have jurisdiction to grant a divorce even when one spouse is living abroad. The Divorce Act 70 of 1979 provides a basis for a South African court to hear the matter where either party is domiciled in South Africa, or where one party has been ordinarily resident in South Africa for at least one year immediately before the action is instituted.

You do not have to wait for your spouse to return.
The complexity, however, lies in the procedure.

Serving divorce papers on a spouse in another country is not the same as handing them to someone down the road.
There are formal processes governing how service must be effected outside South Africa, and getting this wrong can delay your matter significantly or expose you to a challenge later.

The rules require careful attention, and the method of service may also depend on the country where your spouse is living.
There are further practical questions that must be addressed.

What is your matrimonial property regime?
If you are married out of community of property with the accrual system, the calculation of accrual is not suspended simply because your spouse is overseas. Pension interests, property, and maintenance all remain live issues that must be dealt with properly in any settlement agreement or court order.

If children are involved, parenting arrangements take on an additional layer where an international element is present.

The risk of approaching this matter without proper legal advice is significant.

Acting without understanding the procedural requirements, the jurisdictional basis, or the patrimonial consequences can result in delays, costs, or an outcome that does not adequately protect your rights.
