I recently read a short piece on the topic โI want an aggressive attorneyโ.
The piece resonated with me, because I too am asked about this or involved in conversations discussing these types of requests or the outcomes achieved by attorneys who adopt this style of practice.
Such requests are rarely about a genuine need for aggression. More often, they reflect an attempt to compensate for past experiences where their attorney was overly deferential, reluctant to assert necessary positions at the right time, avoided difficult discussions by prioritizing courtesy over effectiveness, focused on fairness or reasonableness when they were both not present, failed to manage expectations candidly, delayed decisive action when it was desperately required at that time or where their attorney lacked authority or credibility by coming across indecisive and weak.
The result is an overcorrection, expressed as a demand for aggression.
