Magistrates Court Rule 58 Application.

The Rule 58 application in the regional magistrates courts of South Africa is the equivalent of a Rule 43 application in the High Court. The rule simply has a different number. Both of them are applications for interim maintenance while a divorce is in progress and taking too long to reach conclusion.

High Court Rule 43 Applications.

Divorce proceedings are notorious for taking long to reach finality. A Rule 43 Application is an inherently urgent High Court Application brought by one of the spouses for interim relief during contested divorce proceedings where it appears that the divorce may not be finalised soon or the other spouse has ceased to comply with his/her obligations particularly regarding maintenance of the minor children or the spouse.

Liquidator and Receiver Services.

We are available to act as independent Liquidator and Receiver to finalise the division of assets after finalisation of your divorce.

As Liquidator and Receiver we assist by:

Requesting compliance from both parties and making sure they provide accurate and proper account of their assets;

Obtaining valuations of all movable and immovable assets of the parties.
Ascertaining and determining the liabilities of the joint estate;

Questioning the parties regarding the assets and liabilities of the joint estate, where necessary;

We will assist in calculating the accrual, sell any immovable property, and even approach financial institutions to obtain financial statements and uncover any hidden or undeclared assets.
