I hope this gives you a light regarding customary marriages πŸ“

Often times we hear people saying that they are not married because they did not register their marriage with the Department of Home Affairs. My dhiye you will cry real tears 🀣🀞.

The Recognition of Customary Marriages Act 120 of 1998 lay down requirements for the validity of a customary marriage. O kwe motho are "o romile bo malome yage ba rera magadi ba patela di half le pudi yao hlotxa gore ke ska tswa ka g*e ka situ. Don't say aka lefa warning !

In terms of the Act, the following requirements must be present:
1. Both parties must consent to be married to each other.
2. Parties must be 18 years or older, if they are minors, consent of the parents or legal guardian will be required.
3.The marriage must be negotiated, entered into or celebrated in accordance with customary law. This means that the marriage must be entered into in line with the traditions and customs of the parties.
4.The parties must be competent to marry each other, meaning that they must not be blood relatives. E.g brothers & sisters are not competent to be married to each other.

Of course the marriage must be registered kua Home Affairs within 3 months of concluding it. However, failure to register such marriage does not invalid it. And for so long as you did not dissolve the marriage through divorce, you remain very much married askies πŸ₯Ί and any subsequent civil marriage will be invalid.

Even the inlaws cannot kick you out when he dies on the basis that you don't have R75 marriage certificate from Home Affairs.
