ADMINISTRATION OF ESTATES:

Process of winding up an estate is the solution to this inevitable stage of life.

South African Law has laid a fairly straightforward process in terms of the Administration of Estates Act 66 of 1965.

TESTATE AND INTESTATE SUCCESSION:
The basic difference between testate and intestate succession lies in having or not having a legally valid will. A will or testament (hereafter referred to as a “will”) is a legal document that regulates what happens to a person's estate (assets and liabilities) after his or her death.

THE WILL:

The Executor:
Key person who is responsible for managing the estate. Once appointed by the Master of the High Court in the form of a Letter of Executorship or Letter of Authority (depending on the value of the estate), their functions include:

1. Take control of the assets of the estate;
2. Protect and preserve the assets;
3. Identify the beneficiaries of the estate;
4. Make sure the administration complies with all legal requirements;
5. Pay the debts and the administration expenses of the estate;
6. Deal with the final income tax return of the deceased; and
7. Distribute the balance of the assets in the estate to the beneficiaries.

The executor could be an individual, such as a family member, or a company, such as a
bank or attorney. It could also be a joint appointment, for example, a spouse with an attorney to provide the expertise.

It is with deep regret and sadness that we have to advise you of the passing of our chairman and leader, John Olpherts Christie.

After a valiant fight he lost his battle to cancer and died peacefully in the presence of his much loved wife and children.

The Directors and staff of J Leslie Smith & Company are deeply saddened by John's death. The next few weeks will be hard, but we all know that John would have wanted us to continue with his life's work:- Understanding that we are in the business of performing exceptional and uncompromising client service based on ethical and sound legal principles and knowledge.
