A last will and testament is a legal document that communicates a person's final wishes pertaining to their assets. It provides specific instructions about what to do with their possessions. It will indicate whether the deceased leaves them to another person, a group, or wishes to donate them to charity.
Having a last will and testament gives you some control over what happens to your assets after your death.

If you die intestate, or without a will, your estate, including the distribution of all assets, is settled by the courts. If parents with children die without a will, the courts will appoint a guardian for those who are minors.
If you have a business or investments, your will can specify who will receive those assets and when. A will also allow you to direct assets to a charity (or charities) of your choice. Similarly, if you wish to leave assets to an institution or an organization, a will can assure that your wishes are carried out.
Your Last Will and Testament must be drafted in accordance with the legal requirements, determined by law.

Many South Africans often misunderstand guardianship. The term guardianship is focused on making important decisions on behalf of the child, such as administering and safeguarding the child’s property and even giving or refusing consent to some issues involving the child.

Guardianship of minors refers to the legal relationship between a guardian and a minor under the age of 18. The guardian is responsible for the care and upbringing of the minor and has the authority to make decisions on their behalf.

Family Mediation is a dispute resolution process aimed at assisting people who are in a relationship with one another, in resolving their dispute without their first having to go the legal route in an attempt to have their dispute resolved.
The process is informal, and it takes place outside of the legal arena hence the process being known as an alternative dispute resolution process or ADR. Parties who choose to go the mediation route are not precluded from accessing the justice system should they at any stage, be of the opinion, that this is what is needed for their matter.

The mediation process is conducted by a third-party facilitator known as a Mediator who is required to remain neutral, non-aligned to either party, and to have no vested interest as to how the dispute may ultimately be resolved.

Trusts are registered at the Master of the High Court and not at the Registrar of Companies. This allows you to give a trust any name you desire. You do not have to first reserve a name as you would do when registering a company.
A trust is given a registration number when it is registered and operates on the same basis as a motor vehicle which has its own individual registration number. Although you can change the name of your trust – should the trust deed allow for this – the trust number will always remain the same and be the identifier of your trust.
A trust will always be registered with reference to the Master of the High Court’s office where it was registered. Each Master of the High Court’s office has its own sequence of numbers for every year.
It is critical to define the purpose and object of the trust clearly in the trust deed, without which the trust may not legally exist.

According to South African Law, the parties who wish to become married out of community of property must enter into an antenuptial contract prior to the marriage ceremony being concluded. If they fail to do so they are automatically married in community of property. Of course, many people are unaware of this provision and should be able to satisfy the court that it should change their matrimonial property system if it was their express intention that they intended to be married out of community of property.
Marriage out of community of property, without the accrual, is comparable to the accrual system. Except that the accrual is not shared between the spouses upon marriage breakup, and each couple keeps the entirety of their respective estate.

Marriage out of community of property, with the accrual is different due to any development or rise in the value of each spouse’s separate estate throughout the marriage (referred to as the “accrual”), is divided equally between the spouses upon the dissolution of the marriage.
