Trusts are registered at the Master of the High Court and not at the Registrar of Companies. This allows you to give a trust any name you desire. You do not have to first reserve a name as you would do when registering a company.
A trust is given a registration number when it is registered and operates on the same basis as a motor vehicle which has its own individual registration number. Although you can change the name of your trust – should the trust deed allow for this – the trust number will always remain the same and be the identifier of your trust.
A trust will always be registered with reference to the Master of the High Court’s office where it was registered. Each Master of the High Court’s office has its own sequence of numbers for every year.
It is critical to define the purpose and object of the trust clearly in the trust deed, without which the trust may not legally exist.

According to South African Law, the parties who wish to become married out of community of property must enter into an antenuptial contract prior to the marriage ceremony being concluded. If they fail to do so they are automatically married in community of property. Of course, many people are unaware of this provision and should be able to satisfy the court that it should change their matrimonial property system if it was their express intention that they intended to be married out of community of property.
Marriage out of community of property, without the accrual, is comparable to the accrual system. Except that the accrual is not shared between the spouses upon marriage breakup, and each couple keeps the entirety of their respective estate.

Marriage out of community of property, with the accrual is different due to any development or rise in the value of each spouse’s separate estate throughout the marriage (referred to as the “accrual”), is divided equally between the spouses upon the dissolution of the marriage.

To change your marital status in South Africa, specifically your matrimonial property regime, you need to apply to the High Court for permission to enter into a notarial contract. This contract, known as a postnuptial agreement, will formally change your marital regime. The process involves demonstrating sound reasons for the change, providing notice to creditors and the Registrar of Deeds, and ensuring no one is prejudiced by the alteration.

To change your marital regime, or the way your assets are managed during marriage, requires a High Court application under Section 21(1) of the Matrimonial Property Act. This involves filing a joint application with your spouse, providing sound reasons for the change, and ensuring no other party is prejudiced. The court will then assess the application and decide whether to approve it.

In South Africa, the Children's Court addresses issues like minor child abuse, neglect, and abandonment, and makes decisions about a minor child's placement and well-beingis, and it is a specialized court within each Magistrate's Court that handles legal matters concerning children, especially those needing care and protection.

The jurisdiction of the Children's Court in South Africa is primarily determined by the location where the minor child involved in the matter is ordinarily resident. If multiple minor children are involved, the court with jurisdiction is where any of those children reside. If there's uncertainty about which court has jurisdiction, the Children's Court where the minor child is brought before has jurisdiction.

The Children's Court procedure in South Africa is designed to be child-friendly and aims to protect minor children's rights and well-being. It involves various stages, including assessments, hearings, potential mediation, and ultimately, decisions regarding the minor child's care and protection.

To initiate a maintenance claim in South Africa, you need to apply at the Maintenance Court within the district where you reside. The process involves completing an application form, providing proof of income and expenses, and attending the court with the person from whom you are claiming maintenance from, on the selected court date by the Maintenance Clerk or Maintenance Officer.

In South Africa, a maintenance court's jurisdiction is primarily determined by the residence of the person seeking maintenance. Generally, this means the maintenance court within the magisterial district where the person claiming maintenance lives has jurisdiction. If the person seeking maintenance for a minor child still under the care of a parent or guardian, the court in the area where that minor child resides has jurisdiction.

Maintenance claims can be lodged at a maintenance court when there is a legal duty to support a minor child who cannot support themselves, and that minor child's parent or representative is seeking to enforce that support. This typically involves cases when one spouse requires support when the parents of the minor child does not reside together, after a divorce or separation.
