Deceased Estates: Who is responsible for administering an estate?
Losing a loved one is difficult enough without having to navigate the complexities of a deceased estate. Understanding who is responsible for the process can make things a little clearer.
In South Africa, the Master of the High Court oversees the administration of deceased estates. The relevant Master’s Office is generally determined by the deceased’s ordinary place of residence during the 12 months before their death.

But who actually administers the estate? 👇
The primary responsibility typically lies with the executor. The executor may be:
📜 Named in the deceased’s Will, or
⚖️ Appointed by the Master of the High Court where there is no Will.
The executor is responsible for handling the administration and winding-up of the estate, while the Master of the High Court provides oversight to ensure the process is properly followed and the interests of the heirs are protected.

This entire process is known as conveyancing and is handled by a conveyancer — an attorney who specialises in property transfers. ⚖️
But did you know that where the property is located can also determine which court has jurisdiction?
When a legal matter involves the ownership, title or real rights in an immovable property, the High Court in the area where the property is situated will generally have jurisdiction over the matter.
In other words, even if the parties involved live somewhere else, the location of the property can determine where the legal proceedings must take place.
