UNLAWFUL ARREST AND DETENTION:

*What is unlawful arrest and detention?

This is when an individual has been wrongfully arrested and detained by the SAPS.

*Can you claim for unlawful arrest and detention?

A person who believes that they were unlawfully and wrongfully arrested and detained by the SAPS can claim for damages (money) against the Minister of Police (SAPS).

*How do you know if your arrest was was wrongful:

There are different factors to consider when assessing a claim for unlawful arrest which an attorney will look at.

1. Was there a warrant of arrest?
2. Was it necessary to arrest instead of serving you with a notice or summons telling you to come to court?
3. What is the offence/crime you were arrested for?
4. What was the outcome of your case?
5. How long were you in detention for?

These are a few of the factors your attorney will consider when assessing whether you have a claim against the Minister of Police.

*How to claim:

Within 6 months of your arrest and detention:

1. Approach an attorney who will assess your matter and see whether you have a claim.

2. If you have a valid claim, your attorney will notify the Minister that you wish to claim for damages against them. (letter of demand)

3. Summons are then issued against the Minister of Police and your matter is then handled by your attorney through different court processes.
