Can your neighbour insist that you cut down your palm tree? 🌴

It's a question we hear surprisingly often.
Imagine you have a large palm tree growing on your property.

From time to time, fronds fall into your neighbour's garden, and they're concerned they could damage a vehicle or create a nuisance.

Can they force you to remove the tree?
Not necessarily.

In South African law, simply owning a tree that sheds leaves or branches does not automatically mean you are required to cut it down.

The key question is whether the tree creates an unreasonable nuisance or poses a genuine risk of damage or injury. Each situation depends on its own facts.

If branches are hanging over the boundary, your neighbour can ask you to trim them. If you refuse, they may generally trim the overhanging branches back to the boundary line themselves, provided they do so reasonably and without trespassing or unnecessarily damaging the tree.

The best solution is usually not found in a courtroom, but in a conversation.

Neighbour disputes can often be resolved through practical discussion and sensible compromise before they become costly legal battles.
