What is Mediation?
Mediation is an effective way of resolving disputes without the need to go to court. It involves an independent third party - a mediator - who helps both sides come to an agreement.
Mediation is a flexible process that can be used to settle disputes in a whole range of situations such as:
*consumer disputes
*contract disputes
*family disputes
*neighborhood disputes
*divorce disputes
*any civil actions and disputes
*labour disputes
The role of the mediator is to help parties reach a solution to their problem and to arrive at an outcome that both parties are happy to accept. Mediators avoid taking sides, making judgements or giving guidance. They are simply responsible for developing effective communications and building consensus between the parties. The focus of a mediation meeting is to reach a common sense settlement agreeable to both parties in a case.
Mediation is a voluntary process and will only take place if both parties agree. It is a confidential process where the terms of discussion are not disclosed to any party outside the mediation hearing.
If parties are unable to reach agreement, they can still go to court. Details about what went on at the mediation will not be disclosed or used at a court hearing.
Both parties share the cost of mediation, which will depend on the value and complexity of the claim.

Mediation:
Part 2
Over the course of the next few weeks we are going to discuss a few of the areas that Mediation plays a valuable role. We would like to provide our clients and followers with information that would help them, a loved one, a friend, or a colleague.
Divorce Mediation:
According to studies conducted by psychiatrists 45 years ago (but still very much valid today), divorce and marital separation are the 2nd and 3rd most significant stress factors in an individual's life.
When someone hurts us, we have an almost instinctive urge to hurt them back. During divorce and marital separation it counts double, the instinctive reaction to protect yourself and the people you care for. We tend to play the blame game and our instinctive nature mentioned above, keeps us in a state of anger and resentment. Couples refuse to cooperate with each other and extend the negotiations trying to get as much as they think they deserve for the trauma based on their hurt and anger, from the other party. They spend large amounts of money trying to get revenge and/or some sense of satisfaction but without really achieving anything in the end.
Mediation gives space to express individual needs and concerns.
A Mediator help the parties to navigate the road to separation and negotiate an agreement they can both live with, keeping the importance of benefit to the whole family as focus. The Mediator guide the couple forward into the future so that they move on constructively with their separate lives.

Mediation:
Part 3:
Divorce mediation is future-orientated and does not dwell on the past. Divorce mediation is solution-orientated and does not apportion blame, guilt or punishment!
Divorce mediation is also the most effective, most inexpensive, manner to divorce.
Divorce mediation is a process and being present and available during the process is important - it is not about walking in, stating your side of the story and waiting for a 'judge' to make a decision that you are bound by whether you like to decision or not. Divorce mediation is about reaching a mutual agreement both parties can comply with. Both parties discuss the pro's and con's, and in that way reach an understanding that has taken into account ALL relevant factors, for and available to both parties and to the benefit of the children.
In the ideal situation mediation is a voluntary action initiated by either one or both parties. Mediation could in certain circumstances also be imposed by legislation and/or the court through court annexed mediation rules on the parties to the dispute.
So now you might ask if the mediation process is conducted by us the parties what exactly does the mediator do?
Well (in a private mediation) the mediator should be a mutually acceptable third party jointly elected by both parties. THE MEDIATOR IS TOTALLY NEUTRAL. Mediators are there to enable the parties to reach agreement by utilizing techniques and strategies, focusing the parties on the reasons for the mediation, bringing them back to the 'drawing board', keeping an objective mind and enabling them to find a solution based on the needs and interests of the parties instead of their position and subjective needs or opinions. During divorce mediation the defined agenda focused on would be a parenting plan and budget allocations for managing joint expenses as well as distribution of assets and liabilities
During mediation the parties are usually not allowed legal representation but it will be allowed in complex situations.
So typically the mediator would begin with both parties present and then from there move to "side meetings" where they consult with each disputing party. The mediation process should be without prejudice, off the record and issues brought out during mediation by the parties cannot be used as evidence at a later stage. Side meetings are strictly confidential.

WORKPLACE HARASSMENT: Part 9:

The intention with this post, and the posts to follow, is not to give legal advice or a scientific study or article, but merely an attempt to bring workplace harassment under the attention of employees and employers. Any comments and assistance in this project will be sincerely welcomed.

How serious is workplace harassment, as we still call it for the moment) regarded by authors?

Hereunder an extract from the website of WORKPLACE BULLYING INSTITUTE (http://www.workplacebullying.org/) – the only institute in the U.S.A. combating the phenomenon of workplace harassment. For interesting sake, harassment at the workplace in the U.S.A. is called by the name “WORKPLACE BULLYING”.

Workplace Bullying: Dare we call it terror?
“Posing this question on the internet is risky, certain to draw unsolicited government surveillance attention in paranoid America. You see, terror existed before America’s Sept. 11, 2001. Just ask Britain. We should be able to use the word when it applies to a variety of situations. But after 9-11, the semantic gods yielded control of the term to western governments.

Here is Merriam-Webster’s definition:

1: a state of intense fear

2 a : one that inspires fear : scourge b : a frightening aspect c : a cause of anxiety : worry d : an appalling person or thing; especially : brat

3: reign of terror

4: violent or destructive acts (as bombing) committed by groups in order to intimidate a population or government into granting their demands

Middle English, from Anglo-French terrour, from Latin terror, from terrēre to frighten; akin to Greek trein to be afraid, flee, tremein to tremble First Known Use: 14th century

Thus, a practitioner of terror, the terrorist, is a person who deliberately instills fear and anxiety in others in an intimidating fashion. Isn’t that what a workplace bully does when she or he abuses others? From fear comes paralysis. Shocked and paralyzed targets and witnesses do not respond to aggression with aggression.

Look at the fourth term in the above definition. The goal of intimidation is have “a population or government,” proxies for organizations, grant the bully’s demands. Bullies get their way with their employers. Perpetrators are rarely punished. They abuse others with impunity, rarely facing consequences. American employers do next to nothing to stop bullies while innocent guileless targets lose their jobs, livelihoods and sanity at alarming rates.

Logically, workplace bullies are terrorists within organizations. They are organizational terrorists. Their actions fit the definition. We simply are applying a label appropriately.

Bullying is not simply eye rolling as bully apologists like to characterize it. It is workplace violence, albeit a non-physical form. It is a mistake to underestimate the effects verbal abuse, threats, intimidation, humiliation and domination have on human beings.

History is on our side. The founder of the international movement in Sweden, Heinz Leymann, titled one of his early English-language journal articles — “Mobbing and Psychological Terror at Workplaces.” Of course, he chose the term mobbing to connote the interpersonal destruction of workplace victims by multiple perpetrators. To assess the extent to which a target was harmed, he developed his own instrument, the LIPT, the Leymann Interpersonal Psychological Terrorization scale. Leymann minced no words. He died in 1999 before other nations followed America’s descent into paranoia about terrorism. I wonder how close he was to naming the phenomenon we know today as bullying, terrorization.

When Dr. Ruth and I made the commitment to begin the work which evolved into the Workplace Bullying Institute back in 1996-97, we had a choice of two reasonable terms. Mobbing was the Scandinavian and European term. Workplace Bullying was the British term. We deliberately chose to import “workplace bullying” for a variety of reasons. We originally did discuss “terrorization,” but felt it would be considered too radical to be accepted by American media. A short four years later, Sept 11 happened. The movement would have been stopped in its tracks for adopting anything related to “terror.”

Looking back after more than 17 years, in the spirit of realistically naming the destructive force that workplace bullying is, I now see “terrorization” as an entirely appropriate synonym to add to the list of acceptable terms. Invoking Leymann’s courage to call it what it is, bullying is terrorism”. (Our emphasis).

Which employers will launch a “war” against it within their walls?

This is a wake-up call to all Bullies and employers who allow harassment at the workplace and let it go unpunished. As initially stated, it is our intention to do whatever is necessary to create awareness of this toxic phenomenon in South Africa.
