Buying, renting, or building a home? South African law protects you under the Consumer Protection Act (CPA) and other property laws.

You have the following rights amongst others:

1. Right to full disclosure
Sellers, agents, and developers must be honest about defects, costs, and conditions before you sign the contract .

2. Right to fair contracts
No hidden clauses or unfair penalties can be included in the contract , you have a right to cancel or terminate in certain cases.

3. Right to quality and safety
New homes, renovations, or building materials must meet approved standards. Builders and developers can’t cut corners.

4. Right to fair marketing
Property ads must be truthful , not make fake or misleading promises.

5. Right to cancel within 5 business days of signature of the contract
If you signed due to direct marketing, you can cancel without penalty within 5 days , this is referred to as the cooling off period.

Please note that If your rights are violated you can
report to the National Consumer Commission (NCC) and or National Home Builders Registration Council (NHBRC). You can seek legal representation for any assistance .

Remember South African immovable property ( stand / house / farm ) can only be purchased in writing not verbally . Please avoid payment without involvement of a conveyancer.

The PIE Act 19 of 1998 protects people from being unlawfully evicted from their homes or land.
It gives procedures that must be followed before anyone including a landlord, private owner, or municipality can remove an occupier.

It is illegal for anyone to:
1. Change the locks,
2.Remove belongings,
3.Cut off water/electricity, or
4.Physically force someone out without a court order, even if the person is not paying rent or has no legal right to stay, they cannot be evicted without a court process.

To lawfully evict someone, the owner or municipality must Serve written notice which indicates the grounds of eviction and the court date .The occupier may appear in court and give reasons why eviction should not be granted.The court must consider Whether the eviction is just and equitable; How long the person has lived there; Whether there are children, elderly, or disabled persons involved; and
Whether alternative accommodation is available.

: Only after the court grants an eviction order may the Sheriff of the Court carry it out.
