In this judgment delivered on 28 February 2024, the Johannesburg High Court upheld the principle that sellers cannot use a voetstoots clause to avoid disclosing known latent defects in a property.

The judgment concerns an appeal against an order for damages for the non-disclosure of defects in a property sale, particularly dampness and a crack in the swimming pool. Arguments on behalf of the parties addressed the applicability of the voetstoots clause, joint and several liability, and the quantum of damages.

The court dismissed the appeal with costs and affirmed that the obligation to disclose latent defects in property sales exists regardless of the presence of a voetstoots clause. The court found that the defects constituted latent defects not disclosed by the appellants, who were aware of the issues but failed to disclose them. The court also upheld the quantum of damages awarded based on the cost of repairs necessary to remedy the defects.
