Minimum wages

An employer who is found to have failed to comply with the NMW (National Minimum Wage) will be fined by a labour inspector an amount equal to twice the value of the underpayment or twice the monthly wage, whichever is greater for first offenders, and, an amount equal to three times the value of the underpayment or three times the monthly wage, whichever is the greater, for repeat offenders.

Apart from the penalties mentioned, the Department is required as per section 76 (4) of the NMW Act, to publish on its official website, on a quarterly basis, all the employers that were issued with compliance orders for failure to comply with the NMW.

Employers must refrain from making deductions from employee/s salaries without them agreeing in writing or there being a debt specified in the written employment particulars or the deduction is required or permitted by law, collective agreement, court order or an arbitration award or where a deduction is as a result of loss or damage to reimburse the employer.

Sometimes in implementing the NMW, employers unilaterally reduce the employees' hours of work. That will be regarded as an unfair labour practice. Employees can refer this unfair labour practice to the CCMA in terms of the Labour Relation Act 66 of 1995 (LRA) as amended -sections 191, 193, 194(4) and 195.

Employers often think they can get away with not paying minimum wages or the unilateral changing of the employees' condutions of employment. To those employers the following warning: You can run and you can hide but someday it's going to catch up on you and once caught, you're on the departments radar and you can expect more frequent visits and full inspections where you will be required to give account of full compliance (i.e. UIF, written particulars of employment, salary advices, compliqnce with minimum wages to mention but a few).

Constitutional Court on the Fi****ms Control Act
The Constitutional Court has recently ruled on certain sections of the act that the High Court previously declared invalid. The High Court order had been dismissed by the highest court in the country, which found the relevant sections to be clear and valid. In essence this means that firearm owners who failed to renew their licenses timeously are now illegally in possession thereof. Firearm owners are now essentially obliged to hand in their fi****ms at SAPS to avoid prosecution.
It seems as if SAPS will not proceed with prosecution as a matter of course but will afford them the opportunity to hand in their fi****ms without fear for prosecution.
