Our client was customarily married and she approached us for assistance with divorce, husband defended divorce disputing the existence of the customary marriage alleging that it was a vat n sit. We managed to prove to regional court that a valid marriage was concluded, however presiding officer erred in ordering that pension interest which must be paid to our client must be calculated from date of marriage until date of divorce, we took the matter for appeal to the High court and judgement was granted in favour of our client in that client will now get 50% of all pension interests without limitations.
