Point of Concern:

Section 2(1) of the Alienation of Act, 1981 (Act No. 68 0f 1981) says: "No alenation of land shall be of any force or effect unless it is contained in a deed of alienation (contract) signed by the parties thereto or their agents acting on their written authority".

Section 6 of the same Act provides the details of the contents that must be contained in the contract.

So good people stop the practice of selling and buying houses and stands by way of verbal agreements, especially in the township; or by signing affidavits at the police station. Such practices are not legally enforceable in law.

The owner can come and claim his or her house or land back after you have made significant improvements that have cost you dearly.

The wise thing to do is to always approach and consult an Attorney before tying yourselves to such transactions.

Point to note: The Mbombela Local Municipality is erecting or making speed humps in and around our Townships (Kanyamazane, Kabokweni, Kamsogwaba, KaDaantjie, Dwaleni, Zwelisha and the surrounding areas). This is a good thing for the safety of our kids, friends and families.

The problem is that there are no road markings and signs to warn drivers about the presence of these speed humps; and motor vehicles get damaged when they drive and bump into these speed humps unwarned and unexpectedly.

In the event your vehicle gets damaged as a results of these speed humps, you must know that you have a legal claim against the Municipality for their negligent behaviour in this regard.
