There is a problem in South Africa with people who are married by Customary Law not registering their customary marriages at Home Affairs.

PLEASE NOTE: Home Affairs has extended the period within which Customary Marriages may still be registered from 1 September 2024 to 31 August 2026. Go and register your customary union if you have not done so.

It is in your best interest to do so.

Is "In Community of Property" really cool?

Sharing everything in a marriage is great. However, sharing the debts is what gives a sour taste to this marital system. Arguably, the main disadvantage for the "in community of property" system, is the liability of both spouses for debts incurred by the other spouse.

Suppose one spouse ventures into business and things go awry and she/he incurs a lot of debt. Because this is a "community of property" marital system, the money owed to the creditors, will be recovered from the joint estate. The family could be left with nothing. This however, would obviously not be the case with a marriage "out of community of property".

Thinking of changing your marital system? Yes you can. Section 21 of the Matrimonial Property Act, makes provision for spouses to apply to court for permission to change their marital property system.

Also, should marriage be on the horizon, think on this disadvantage of "community of property" and perhaps consider an Ante Nuptial Contract.

An Ante Nuptial Contract is a contract which spouses enter into before marriage, in which they stipulate how their property will be shared or not shared during and after the marriage.

Did you know that you cannot bequeath pension benefits in a Will, as the Pension Funds Act provides for this?

Did you also know that you cannot, in your Will bequeath the proceeds of an Insurance Policy where there is a beneficiary nominated and such beneficiary is different from the one in the Will?

This is in line with the Legal Principle, which provides that, statutory provisions and contractual agreements take precedence over testamentary dispositions.
