“What happens when a golf club suspends someone and years later refuses their re-admission without providing any reasons?”

Jaco Ackerman, a former captain of Mbombela Golf Club, was suspended in 2016 following a disciplinary process.

Years later, he reapplied for membership, but his application was rejected.

The matter eventually reached the High Court, where the court found on two separate occasions that the club’s management committee had acted unlawfully. Following the first court ruling, the club once again rejected Ackerman’s application.

The court held that the management committee had failed to comply with the club’s own rules when considering Ackerman’s application and described its refusal to provide reasons for its decision as unacceptable. The court set aside the club’s decision for a second time, referred the matter back to the management committee, and ordered that a newly constituted committee reconsider Ackerman’s application.
