Lawyers are paying dearly for being part of the LPC, our independence and ability to run our own affairs was greatly compromised by allowing the government to be part of it or play a part in the appointment of its executives. We cannot have lawyers being regulated by government nominees whose interests have nothing to do with us. Given chance and opportunity we should revert to the re-establishment of our law societies. Under the LPC annual membership fees have almost quadrupled within one year of its establishment. Over and above this, for those of us who applied for permits directly to the LPC during the lockdown under level 5 regulations - we have never received any reply to our applications. Briefly our ability to run our own affairs as lawyers is almost gone and our faith in the LPC remains half-hearted. We miss the old law societies.

the law is an ass, the law hasn't got a child - is the role of the law to proscribe certain behaviour or set social standards?

the latest Constitutional Court case on spanking of children has left many people - especially parents - up in arms with many feeling that the Court in its ruling is intruding in their private sphere insofar as raising of their children is concern. it is to be noted throughout human history that no society is static: change insofar as it has to do with the dignity of others - especially children being the most fragile and vulnerable members of the society who cannot speak for themselves - is necessary. the role of the court, including the law, is not only to proscribe certain behaviour but also to set standards that aim to make us better members of society. if it was not for the courts women could still be subjected to the treatment and level of children by their partners, black kids could still be attending schools in the townships and ghettos only, women could not have the absolute right and control over decisions concerning their body, there could be no affirmative action, slavery could be the norm. Briefly there are many of ways of disciplining children - spanking is not the recommended way. Let's allow our society to evolve as we have done so in the past. the law is not an ass in the right hands.

Is anyone following the Julian Assange case ...well his arrest was inevitable but his case is quite unique and it begs many questions - does exposing information about infringement of the rights of innocent people by the US Government in its fights against terrorism amount to breach of US interests and if so is the right of US government to protect its interests more important than the civil liberties of individuals, including its citizens, who are reporting on abuse of civil liberties by the US government? Whatever the answer to this question - Assange Case will have a bearing on three aspects: 1. Freedom of speech 2. The right to disseminate information by journalists and their right to refuse to disclose the source of their information 3. The right for independent investigative organizations to conduct their investigation in exposing the abuse of civil liberties by Western governments. Lastly, we also want to find from our colleagues from human rights background of the circumstances in which a person may have their asylum revoked - in the context of international law and human rights - especially refugee law - whether Ecuador in revoking Assange’s asylum was entitled to invite UK security agencies to arrest Assange as opposed to resettling him in another country?

In this current political climate in South Africa no sane lawyer outside of the Office of State Attorney wants to work for the State ... it's really a career su***de working for the State. The worst part the Courts are seemingly not helping the situation - many legal eagles who endeavour to do their work honestly and competently are being hounded, if not harassed, by political parties and NGOs for simply doing their job to the best of their ability and disagreeing with politicians and NGOs in their opinions. Employment by the State and security of tenure of lawyers working for the State other than the Office of State Attorney is now wholly depended on the discretion of politicians and NGOs. We shudder to think what will happen to lawyers not working for the State following the implementation of the Legal Practice Act and coming into existence of the Legal Practice Council. Politicians and NGOs have become the biggest problem to the independence of lawyers, unfortunately statutory institutions and regulatory bodies that are meant to protect lawyers have become complicit and docile in the face of harassment of lawyers by the State, politicians and NGOs.
