MEC for the Department of Health Free State Province v G.A.K obo M.A.K (2795/2015) [2024] ZAFSHC 142 (25 April 2024)
The MEC for Health of the Free State brought an appeal application against a decision of the High Court which held them liable 100% for negligence and awarded the amount of R2,400,000.00 (R2.4 million) to the minor child for general damages.
The minor suffered a hypoxic-ischaemic incident due to asphyxia, meconium aspiration syndrome, and/or respiratory distress syndrome causing her to sustain severe brain damage. As a result of this she is suffering from cerebral palsy due to the negligence of the medical - and nursing staff at the Elizabeth Ross Hospital.
The Applicant argued that the damages awarded by the Court a quo should be decreased since the life expectancy of the child has diminished due to the brain damage she suffered.
The Appeal Court held that the life expectancy of a child suffering from cerebral palsy should not be a factor in reducing the amount for general damages. The appeal was accordingly dismissed with costs.

A: Contact your attorneys immediately (if you don’t have one, appoint one – many, like us, may work on a contingency basis on cases such as yours).

Do not accept any offers. Don’t even discuss the matter with them. They will try and get you to settle for a sum far less than you deserve. We won’t let that happen.

Q: Is there a time limit for submitting claims with the RAF (Road Accident Fund)?
A: Yes, 3 years from the date of the accident, if the driver that caused it is known to you. A summons must be served within 5 years of the collision date.

Did you know that even if the driver is unknown, a claim can be submitted? This however must take place within 2 years of the accident date.
