Before you make a loan to anyone, be sure to comply fully with the strict requirements of the National Credit Act.

If you don’t, you could lose your loan entirely, with a recent High Court decision providing a stark reminder of the consequences. The Court declared a R430,000 loan to have been “reckless lending”, leaving the lender (a family trust) to write off the bulk of its loan, lose a decade’s worth of interest, cancel its security bond over a house, and pay legal costs. We’ve all grumbled about being endlessly F**A’d and RICA’d. “Waste of time,” we mutter as we wade through all the red tape yet again. Compliance certainly is a hassle, but don’t blame the bank, service provider or conveyancer who asks for it. They are legally obliged to ensure compliance, and so are you.

But F**A and RICA? Yes, in some instances (like applying for a cellphone contract) both will be necessary. That’s because F**A (the Financial Intelligence Centre Act) focuses on fighting money laundering, tax evasion, and terrorism funding by verifying your identity and scrutinising financial transactions. RICA (the Regulation of Interception of Communications Act) focuses on telecommunications, requiring SIM cards and internet connections to be linked to a verified owner. Neither is of course anywhere near foolproof in fighting crime, but they do help – to everyone’s benefit.

The rewards of company directorship come with a caution: the duties and responsibilities imposed on you by the Companies Act need constant management. Drop the ball on that and you could face some seriously negative consequences.

We’ll discuss one of those risks – the career-threatening risk of being declared a “delinquent” director – in the context of two recent court judgments which involved large amounts of money, seriously disaffected stakeholders, and 7-year bans from holding any position at director or senior management level.

The National Minimum Wage (NMW) for each “ordinary hour worked” has been increased from 1 March 2026 by 5% from R28,79 per hour to R30,23 per hour.

Domestic workers: Assuming a work month of 22 days x 8 hours per day, R30,23 per hour equates to R241,84 per day or R5320,48 per month. Of course, this is just the bare legal minimum. The Living Wage calculator will help you check whether you are actually paying enough to cover a household’s “minimal need” (adjust the “Assumptions” in the calculator to ensure that the figures used are up-to-date).
