JURISDICTION

South African law, jurisdiction refers to the legal authority of a court to hear and decide a case. If a court does not have jurisdiction, it cannot properly deal with the matter.

There are a few key aspects to understand:

1. Types of jurisdiction
🔻Territorial jurisdiction
This is about where the case can be heard. A court generally has jurisdiction over matters that arise within its geographic area (e.g. where the defendant lives, works, or where the cause of action occurred).

🔻Personal jurisdiction
This relates to who the court has authority over. Typically, a South African court has jurisdiction over a person if they are domiciled, resident, or present within its area.

🔻Subject-matter jurisdiction
This determines what kind of case a court can hear. For example:
The Magistrates’ Court handles less complex or lower-value civil matters.
The High Court deals with more serious or higher-value matters.

🔻Monetary jurisdiction
Some courts are limited by the amount of money involved in the dispute. For instance, Magistrates’ Courts have financial limits, while the High Court does not.

2. Why jurisdiction matters
Jurisdiction is crucial because:
▪️It ensures cases are heard in the correct court.
▪️It prevents abuse of the legal system (e.g. suing someone in an unrelated area).
▪️It can affect costs, procedure, and strategy.

If a case is brought in the wrong court, the other party can raise a special plea of lack of jurisdiction, and the matter may be dismissed or transferred.
