WHO MAY CLAIM ? Any person who was legally dependant on the deceased for maintenance. For example:
• Widow;
• Dependant children or adopted children
• Any person who was seriously injured in a motor vehicle / pedestrian accident due to the negligence of another driver. WHAT CAN I CLAIM ? LOSS OF SUPPORT - A dependant may claim loss of support from the Road Accident Fund. The loss of support is the direct financial loss suffered by the dependants of a breadwinner. GENERAL DAMAGES - Long term impairment and / or loss of body function. Serious disfigurement. LOSS OF EARNINGS - Proven records of past and / or future loss of earnings. MEDICAL EXPENSES - Past and or future loss of medical expenses.
2. MEDICAL NEGLIGENCE
Cases where medical or hospital negligence is suspected. A claim for medical or hospital negligence occurs when a medical healthcare worker performs an act or omits to perform an act which then results in injury or death to the patient.
