South Africa’s draft Labour Law Amendment Bill and Labour Relations Amendment Bill could significantly reshape workplace compliance if enacted.

Employers should start preparing now.

◾️ 1. New Protections for On-Call & Flexible Workers
Employers may be required to provide written terms covering:
✔ Guaranteed hours
✔ Availability periods
✔ Notice periods for shifts
✔ Compensation for cancellations
This will directly impact industries like hospitality, retail, security, and restaurants.

◾️ 2. Changes to Probation & Dismissal Processes:
The proposals may introduce clearer probation rules and limit reinstatement remedies for certain high-earning employees, shifting some disputes toward capped compensation instead.

Draft amendments aim to align UIF and BCEA provisions with Constitutional Court rulings, creating a more inclusive gender-neutral parental leave framework.

🚨 IMPORTANT UPDATE FOR EMPLOYERS & EMPLOYEES 🚨

As of 1 May 2026, the earnings threshold under the Basic Conditions of Employment Act (BCEA) will increase to R269,600.90 per annum (approximately R22,466.74 per month), up from R261,748.45.

What does this mean? 👇

✅ Employees earning BELOW the threshold are entitled to full protection under certain provisions of the BCEA, including:
• Ordinary working hours
• Overtime pay
• Meal intervals
• Daily and weekly rest periods
• Certain leave and related protections

⚠️ Employees earning ABOVE the threshold may be excluded from specific mandatory protections in these areas mentioned above.

📌 What counts as “earnings”?
This refers to an employee’s regular annual gross remuneration before deductions such as tax, pension, commission or medical aid.

❌ Excluded from the calculation:
• Employer contributions (pension/medical aid)
• Travel or subsistence allowances
• Performance bonuses
• Overtime payments

💼 Atypical employees & labour broker staff:
The threshold also affects the application of “deeming” provisions for certain fixed-term contract employees and labour broker workers, who may be deemed permanent after 3 months if they earn below the threshold.

📋 Action for Employers:
Now is the time to review your employment contracts and payroll structures to determine which employees fall above or below the new threshold. Staying compliant reduces labour risk and protects your business.
