⚖️ MISCONDUCT vs INCAPACITY: Do You Know the Difference? ⚖️

Employers often confuse misconduct and incapacity, but they require very different approaches under labour law.

◻️MISCONDUCT

A matter of choice and behaviour. The employee can perform their duties but chooses not to comply with workplace rules or standards:

✔️ Insolence or disrespect
✔️ Dishonesty
✔️ Absenteeism without valid reason
✔️ Failure to follow lawful instructions
✔️ Breach of company policies

The focus is on fault, accountability, and appropriate disciplinary action.

◾️INCAPACITY

A matter of inability, not unwillingness. The employee is unable to meet the required standard due to factors such as:

✔️ Poor work performance
✔️ Ill health or injury
✔️ Lack of skill, ability, or capability

The focus is on support, guidance, investigation, and reasonable opportunity to improve or accommodate where applicable.

💡 The key question to ask:
“Won’t the employee comply, or can’t the employee comply?”

Getting this distinction right is essential to ensuring a fair and lawful workplace process.

⚖️ PROPOSED LABOUR LAW AMENDMENTS UNDER REVIEW | WHAT SA EMPLOYERS NEED TO KNOW 🇿🇦

South Africa’s draft Labour Law Amendment Bill and Labour Relations Amendment Bill could significantly reshape workplace compliance if enacted.

Employers should start preparing now.

◾️ 1. New Protections for On-Call & Flexible Workers
Employers may be required to provide written terms covering:
✔ Guaranteed hours
✔ Availability periods
✔ Notice periods for shifts
✔ Compensation for cancellations
This will directly impact industries like hospitality, retail, security, and restaurants.

◾️ 2. Changes to Probation & Dismissal Processes:
The proposals may introduce clearer probation rules and limit reinstatement remedies for certain high-earning employees, shifting some disputes toward capped compensation instead.

◾️ 3. Expanded Parental Leave Benefits:
Draft amendments aim to align UIF and BCEA provisions with Constitutional Court rulings, creating a more inclusive gender-neutral parental leave framework.

◾️ 4. Broader Definition of “Employee”:
Platform and non-traditional workers (including some gig workers) may receive expanded labour protections and bargaining rights.

◾️ 5. Increased Employer Compliance Obligations
Expect stricter scrutiny around:
• Employment contracts
• Work scheduling practices
• Retrenchment procedures
• Employment Equity alignment

🚨 IMPORTANT UPDATE FOR EMPLOYERS & EMPLOYEES 🚨

As of 1 May 2026, the earnings threshold under the Basic Conditions of Employment Act (BCEA) will increase to R269,600.90 per annum (approximately R22,466.74 per month), up from R261,748.45.

What does this mean? 👇

✅ Employees earning BELOW the threshold are entitled to full protection under certain provisions of the BCEA, including:
• Ordinary working hours
• Overtime pay
• Meal intervals
• Daily and weekly rest periods
• Certain leave and related protections

⚠️ Employees earning ABOVE the threshold may be excluded from specific mandatory protections in these areas mentioned above.

📌 What counts as “earnings”?
This refers to an employee’s regular annual gross remuneration before deductions such as tax, pension, commission or medical aid.

❌ Excluded from the calculation:
• Employer contributions (pension/medical aid)
• Travel or subsistence allowances
• Performance bonuses
• Overtime payments

💼 Atypical employees & labour broker staff:
The threshold also affects the application of “deeming” provisions for certain fixed-term contract employees and labour broker workers, who may be deemed permanent after 3 months if they earn below the threshold.

📋 Action for Employers:
Now is the time to review your employment contracts and payroll structures to determine which employees fall above or below the new threshold. Staying compliant reduces labour risk and protects your business.
