The Constitutional Court clarifies the legal position that an Antenuptial Contract must be concluded before entering into a Customary Marriage.

What you should know:

1. An Antenuptial Contract must be concluded before entering into a Customary Marriage.

2. Failing this, the parties will be regarded as married in community of property.

3. It is not possible to enter into an Antenuptial Contract after Lobola had been paid but before the white wedding, as the marriage is already deemed to exist in community of property.

4. Should the parties wish to change their marital regime thereafter, an application to Court is required.

Note that an Antenuptial Contract is prepared & notarised by a Notary Public (an attorney admitted as such)
