WHAT HAPPENS IF A PARENT WITHHOLDS THEIR CONSENT FOR A CHILD TO ACQUIRE A PASSPORT?

We are at that time of year again whereby the tension is high as festive season arrives and the Parents of Minor Children are racing to see what type of holidays they can have.

Some go domestic and stay in the beautiful Republic of South Africa and others prefer the comfort of going overseas.

When a Parent would like to take their Children overseas it is common cause that a Passport is required, meaning that both Parents would need to consent to having a Passport made by the Department of Home Affairs.
What happens if one of the Parents declines to do assist the other Parent in acquiring a Passport?
In terms of the Constitution of the Republic of South Africa, 1996 (as Amended) EVERYONE has the right to own a Passport therefore a Minor Child may own one.
Should a parent not consent to this an Application may be made to the High Court Of South Africa requestion that they (the Court) make an Order to limit the obstructive parents Parental Rights and Responsibilities so that the other Parent may apply for the Passport without the consent of the other Parent.
There is a procedure to follow on this basis however, this is very subjective to the Parties and the fact which are placed in front of the Courts therefore, in order to understand the processes you would have to come and consult with us in order to understand and acknowledge your rights
