Can a homeowners’ association compel an owner to remove an alteration simply because it does not suit the scheme’s preferred aesthetic?

In Gateside Manor Homeowners Association v Hamisi and Others, the Gauteng High Court confirmed that aesthetic preference alone is not enough.

The HOA’s governing documents did not clearly prohibit synthetic grass when it was installed. A resolution adopted afterwards could regulate future conduct, but it could not retrospectively turn the owner’s earlier conduct into a breach.

The judgment sends an important message to community schemes: the more drastic the remedy such as removal, demolition or restoration the clearer the rule-based authority must be.

Before taking enforcement action, ensure that the governing documents expressly support the remedy being sought.

When does an HOA rule go too far?

The recent judgment in Baronetcy Estate Homeowners Association v Abdulahi provides an important reminder that the contractual nature of community scheme rules does not place them beyond legal scrutiny.

The matter dealt with an architectural height restriction, an application seeking demolition of part of an owner’s dwelling, and substantial penalties arising from the alleged breach of the scheme’s rules.

The judgment highlights three important considerations for community schemes:
1. Architectural rules must operate within the applicable municipal planning framework.
Where municipal legislation expressly restricts an association’s ability to introduce more onerous development rules, contractual enforcement may face difficulty.

2. Penalties must remain proportionate.
The fact that a governing document provides for a fine does not necessarily mean that a court will enforce that amount without considering the actual prejudice suffered and the surrounding circumstances.

3. Litigation strategy matters.
Identifying a rule and establishing a breach is only part of the equation. The evidence, documentation, relief sought and proportionality of that relief can ultimately determine whether a case succeeds.

The takeaway?
Strong governance is not about enforcing every rule at all costs. It is about ensuring that the rule, the penalty and the remedy are legally defensible.

📢 INDUSTRY UPDATE: PPRA Clarifies Trust Accounts and Debit Orders for Managing Agents

One of NAMA's core responsibilities is to advocate for the interests of our members and the community scheme management industry.

Following concerns raised by NAMA members regarding the use of debit orders on trust accounts, NAMA formally engaged with the PPRA and requested clarification on the practical application of the regulatory requirements.

We welcome the PPRA's confirmation that debit order facilities may continue to be used for approved recurring community scheme expenses, provided that the necessary authorisations, internal controls, reconciliations and audit measures are in place.

This clarification provides much-needed certainty for managing agents responsible for ensuring the uninterrupted payment of essential services such as utilities, insurance, security and other operational expenses, while maintaining compliance with legislative and governance requirements.

NAMA is proud to have represented the concerns of its members and to have contributed to achieving a practical outcome that supports both sound governance and the efficient management of community schemes.

JUST IN: A WELCOME AND PRACTICAL DEVELOPMENT IN TRUST ACCOUNT PRACTICES FROM THE PPRA

Following the PPRA’s earlier communiqué regarding banking practices for trust funds, HP Inc. placed detailed industry feedback before the PPRA on the practical difficulties that a blanket prohibition would create for managing agents administering community scheme funds.

The concern was simple: managing agents are not merely holding isolated deposits. They administer the day-to-day financial obligations of community schemes, including recurring payments for utilities, insurance, security, telecommunications and other essential services.

The PPRA has now issued an important clarification note recognising the unique operational environment of managing agents and confirming that debit order facilities may be maintained on trust accounts for specified recurring community scheme obligations, provided that proper authority, controls, allocation, reconciliation and audit safeguards are in place.

The clarification is also an important reminder that compliance and practicality are not opposing concepts. With the correct legal engagement, proper governance and responsible safeguards, community scheme administration can remain both efficient and defensible.
