I have seen lots of people struggle to articulate their case. Case preparation is an important but usually overlooked step before a hearing or arbitration. You already have a charge sheet and know what case you have to meet in most cases. Prepare a statement with your version and use it to refresh your memory when you testify. Tell a story when you give evidence, chronologically if you can so that your version is comprehensible. Avoid being all over the place.

When you attend a hearing or arbitration relating to your dismissal or unfair labour practice dispute, you need to produce the evidence you are relying on. Sometimes it is not enough to just say that "X sent an email that said..." Produce the email! When you prepare your bundle of documents, make three copies of each document and number them chronologically.

What is an unfair labour practice?

It is unfair treatment by an employer to employee or job applicant. Unfair labour practice is limited to the instances and treatment defined in the LRA.

When is dismissal unfair?
A dismissal is unfair when it is not in accordance with a fair procedure (procedural fairness) and not for a fair reason (substantive fairness).

An employer can dismiss an employee for:
Misconduct;
Capacity; and
Operational Requirements.
