Beware the employee of whom relies and listens to rumours in the workplace that suggest that restraint of trade agreements beyween an employer and employee cannot be enforced. Our Courts apply the rule of law that restraints of trade agreements are contracts that are generally enforceable and each restraint whether enforceable or not is considered on its unique and individual merits. Take good legal advice before you as an employee attempt to conduct yourself contrary to the terms of any such agreement of restraint of trade or you may just find yourself in some hot water.
