Whilst prescription is a fairly easy concept to understand, its application is not always so clear cut.

The aforegoing was recently illustrated in the Supreme Court of Appeal (“SCA”) judgment handed down for Holden v Assmang Limited (Case no 1277/19) [2020] ZASCA. In this case, the SCA had to decide whether or not a claim for damages based on malicious prosecution had prescribed prior to the plaintiff’s institution of legal proceedings.
