In today's edition of we look at issues of Child Maintenance.

Often questions arise when a child is born and they are supposed to be maintained/supported in terms of their needs.

Before going any further let's answer the question of what actually maintenance is, what does same refer to. Maintenance can be described as an amount of money that a person has to pay towards another person based on a legal duty to support that particular person.

A legal duty to support a person is based on the relationship between the persons, the need to be supported and the ability to support.

Who should pay Child Maintenance?
It is the legal obligation of both parents, grandparents or legal guardian of the child/Ren to support the child.

One of the questions which is frequently asked is at what age should one stop paying maintenance? The answer to this is found in the Maintenance Act and same is that maintenance should be paid until the child is self-supporting. This often raises further questions as to whether a parent should continue to support their 35 year old child who is not self supporting. To answer this we need to look at the circumstances surrounding each case, we need to look at the individual case and not apply a blanket approach towards it.

CAUTION: The Dangers of dying without a Will.

Life sounds so nice when you are still on this planet earth. We enjoy with our friends and family but have you ever thought of what will happen should you kick the bucket at any time?

As much as we prepare for our death with Funeral insurance covers, why not do so with protecting your Family members from unnecessary dramas.

Do you know that upon your death some will be saying, " this is our family house, we are going no where" and others will even allege you verbally said they must inherit your belongings and properties.

We plead with you not to place your loved ones in that situation. Speak even though you are in the grave. Do you want to know how?

that if a person dies without a Last Will and Testament, his/her deceased estate (the assets s/he owned at time of death) will be distributed in terms of the Intestate Succession Act (“Act”). This is also known as the rules of intestate succession.
This means that Due to there being no Will setting out the deceased’s wishes, the Act sets out certain rules in respect of how the deceased estate must be distributed to his/her heirs.

Therefore, the deceased does not have any control of who will inherit from his/her deceased estate if s/he dies without a Will. This can lead to instances where someone inherits even if the deceased may have never wanted that persons to benefit from his/her deceased estate.

A Valid Will cannot be done verbally.

In terms of the Alienation of Land Act, 68 of 1981, the sale of immovable property must be recorded in writing and signed by both parties to be valid.

What does the above mean?
1. You cannot conclude an agreement for the sale of a house, stand or any piece of land verbally.
2. An affidavit cannot serve as a valid document for purchasing a house. Avoid this practice at all costs, it's fruitless.
3. You need to sign a valid Deed of Sale Contract.
4. If the agreement is not in writing or signed by the parties, such an agreement will be null and void.

The above is applicable whether the sale is a cash sale or you are purchasing through the Bank.

It is of the utmost importance that the deed of sale is a custom-made agreement to suit the needs and requirements of both the seller and the purchaser. It is also important that both parties are aware of and understand the contents of the agreement, to avoid unnecessary disputes. Consult us to review your Deed of Sale should you be uncertain of any of the contents of the agreement and also to have same drafted for you.
