Today we commemorate Freedom Day and reflect on South Africa’s first democratic elections in 1994, a defining moment in our nation's history, grounded in the values of the Constitution and the rights and freedom it upholds.

Under this year’s theme, “Freedom and the Rule of Law: Thirty Years of Democratic Citizenship”, we recognise the progress of our constitutional democracy and the ongoing importance of safeguarding rights, advancing equality and strengthening democratic citizenship.

Restraints of trade are a frequent point of contention in South African employment law. While employees have a right to pursue their chosen occupation, recent court decisions highlight that this does not allow for the exploitation of an employer’s legitimate proprietary interests.

Bradley Workman-Davies highlights a cluster of recent cases reinforcing a consistent legal approach: employees are free to leave, but they are not free to take the employer's competitive advantage with them; careful drafting by employers matters; and the courts will continue to balance the employer’s interests against the employee’s right to earn a livelihood.
