Lets talk about cohabitation, a.k.a "fat and sat", "mas'hlalisane"
This refers to couples living together without being legally married.
In South Africa, unlike a legal marriage, cohabitation (masihlalisane) doesn't automatically grant partners the same legal rights and responsibilities
as marriage.
Some legislation includes cohabitants in certain contexts such as the:
Domestic Violence Act, extends protection to cohabiting couples facing domestic violence,
Medical Schemes Act, defines a dependent to include a partner in a cohabitation relationship; and
Income Tax Act and Estate Duty Act treat cohabitants as spouses for tax purpose.
South African law generally doesn't regulate the rights and duties of cohabiting partners.
But did you know that you can have a cohabitation agreement to regulate the terms and condition of your union? Just like in a case of a prenup you can decide what gets to happen in your union.
A cohabitation agreement:
protects the interests of the cohabiting couples;
outlines their rights, responsibilities, and how assets will be divided in case of separation or death
clarifies financial responsibilities, property ownership, and other important aspects of the relationship, promoting transparency and reducing potential conflicts.
